The Plaintiff-Appellant brought the original complaint against the City of New York in Supreme Court, County of New York, for claims related to the Child Victims Act. The Plaintiff-Appellant later amended the complaint to include the Charitable Organization. The New York Court found that the Plaintiff-Appellant failed to include the Charitable Organization in a timely manner and further, even if the Charitable Organization had been included earlier, there was not sufficient evidence to connect the Organization with the City in the claims asserted. The Supreme Court granted motion by Traub Lieberman to dismiss the complaint in favor of the Charitable Organization, which was then affirmed by the New York Appellate Division, First Department.
