In a matter brought in Broward County, FL, Traub Lieberman Partner Michael Logan and Associate Christian Romaguera won a motion to dismiss in favor of a South Carolina-based Caterpillar, Inc. dealer (the “Company”). The Plaintiff claimed that the Company negligently repaired a marine engine while the vessel was traveling from New York to South Florida. However, the Company did not have business dealings outside of South Carolina and had no connection to the State of Florida. The Traub Lieberman team filed numerous motions to dismiss the case for improper venue and lack of jurisdiction, arguing that Florida’s Long Arm Statute could not reach the Company in South Carolina. Although the Court allowed the Plaintiff to amend their complaint numerous times, on the Plaintiff’s fourth attempt, the Court granted the motion to dismiss in favor of the Company. The Traub Lieberman team was proud to have achieved this result for the firm’s client and protected the Company’s Constitutional right to Due Process under both Federal and Florida law.
