Traub Lieberman Partners Lisa Rolle and Erin O’Dea won motion to dismiss in favor of the Defendant in a personal injury action brought in the New York Supreme Court, Queens County. The Plaintiff commenced this cause against three Defendant parties seeking to recover damages from personal injuries allegedly sustained in a motor vehicle accident. The collective Defendants filed a motion to dismiss pursuant to CPLR §§ 3216 or 3126, which provides—among other things—that the pleading may be dismissed if the party unreasonably neglects to proceed in an action or delays. The Plaintiff failed on several occasions meet required filing deadlines and comply with Court Orders. As a result, the Court granted Traub Lieberman’s motion to dismiss.
