Traub Lieberman New York partner, Colleen E. Hastie, and associate Taylor Eagan win summary judgment dismissing plaintiff’s complaint against a liquor store owner on renewal of its motion for summary judgment based on new evidence. Plaintiff alleges he was injured when he slipped and fell on an icy condition on the sidewalk adjacent to a building containing two commercial businesses (i.e, liquor store and grocery store) and second floor residential apartments. On renewal, the court in granting the liquor store’s motion, held that the deposition testimony of the grocery store tenant to evidence that snow removal obligations for the sidewalks was exclusively within the purview of the grocery store.
