Traub Lieberman Partners Lisa Rolle, Erin O’Dea, and Nicole Verzillo obtained summary judgment in favor of their client, a New York City provider of ADA compliant transportation (the “Transportation Company”), in a motor vehicle accident claim brought in the Supreme Court of the State of New York, Kings County. The Plaintiff claimed that they were a pedestrian who came in contact with a New York registered motor vehicle and that they sustained injuries as a result of that contact. The Plaintiff asserted that the Transportation Company was a negligent party in the alleged incident resulting in their injuries. However, in a pre-discovery motion, Traub Lieberman was able to establish that the Transportation Company did not own, operate, maintain, manage, control, lease, or rent the motor vehicle, nor were they the employer of the vehicle’s operator. As a result, the Court dismissed all claims against the Transportation Company.
